These Term of Use (the “Agreement”) are entered into and effective as of the date of your account registration on FundLibraries.org and with the EveryLibrary Institute, NFP (“Effective Date”). This Agreement governs the relationship between the EveryLibrary Institute, NFP, an Illinois Non-Profit Corporation, with offices located at 6433 Fairfield Ave. Berywn, IL. 60402, (“ELI,” the “Organization,” “we,” “our,” or “us”), and you the account holder, user, or licensee (“You” or “User) (collectively, the “Parties”), whether as an individual or as a representative of an entity, and for both Campaign Managers and Donors. The Agreement also covers your use of our website which is designed to enable organizations and individuals to conduct fundraising and to accept donations through our website.

Please read the Agreement carefully before you start to use this website. By using the website, or by clicking to “accept” or “agree” to the Terms of Use when this option is made available to you, or by making a donation or contribution as a guest, you accept and agree to be bound and abide by this Agreement. You also acknowledge and warrant, if applicable, that you have the authority to enter into this agreement.

If you do not want to agree to these Terms of Use or the Privacy Policy, you must not access or use this website.

This website is offered and available to users who are 18 years of age or older. By using this Website, you represent and warrant that you are of legal age to form a binding contract with the Company and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Website.

Terms

Except for the limited rights expressly granted under this Agreement, neither this Agreement nor your exercise of rights granted convey any other rights or license to the Software, Confidential Information, Documentation, and Marks whether by implication or otherwise. We retain all rights, title, and interest in and to the Processes, Confidential Information, Documentation and Marks. 

You can browse FundLibraries.org without registering for an account. You can donate or contribute without creating an account, but to complete a donation or contribution you will need to provide information in the Payment Workflow as required by our 3rd party payment processor Stripe.com. If you choose to create an account on FundLibraries.org you will need to register, choose a username, and set a password among other information. If you create an account you agree to be responsible for all the activity on your account. If you are found to be impersonating anyone else or have chosen a user name that is offensive or that violate anyone’s rights ELI reserves the right to immediately cancel your account. Creating an account on FundLibraries.org is free.

Payments and Processing Fees

Campaign Managers: The fees owed to the EveryLibrary Institute, NFP with respect to successfully completed campaigns on FundLibraries.org will not exceed 10 percent (10%) per unique credit card donation. Aggregate fees will be deducted from the net donation proceeds by ELI prior to issuing a campaign payout. Campaign Managers may cancel and refund a donor or contributor's pledge at any time prior to the completion of your campaign. If you make a refund or refuse a donation, you do not have any obligation to that donor or contributor and no agreement exists between you.

Donors or Contributors: ELI's transactions fees shall not exceed 10 percent (10%) of your donation or contribution. These fees include the Stripe.com processing fees, which will also be deducted immediately at the time of transaction processing. The fees charged do not include any federal, state or local sales, use or other similar taxes. We do not collect any fees without giving you a chance to review and accept them. If our fees change, we’ll announce that on our site. Donors or Contributors can request a refund or void a donation at any time prior to the completion of a campaign. If you request a refund through FundLibraries.org it will be made to back to the original credit or debit card only. Refunds will be processed in a timely way by our 3rd party payment processor Stripe.com. Donations and Contributions cannot be refunded through FundLibraries.org or by the EveryLibrary Institute, NFP for campaigns that have concluded and paid out, as discussed below. 

Tax Deductibility and Reporting 

The EveryLibrary Institute, NFP is a registered 501(c)3 non-profit organization with the Internal Revenue Service. All donations or contributions made by US residents are deductible for charitable purposes under current law and IRS regulation. FundLibraries.org will issue an email receipt from "EveryLibrary Institute, NFP. FEIN 81-4351204" for all valid donations and contributions. Please consult your tax advisor for questions.  

Payouts and Settlements

Campaign Managers agree and understand that ELI will process and fund campaign payouts on or about the 15th and 30th day of each month for any and all campaigns that have either met their payment thresholds or have come to a pre-set close or end in the two weeks proceeding the payout date. ELI will charge all fees before crediting your campaign. ELI will issue a campaign payout to registered Campaign Managers by [check or by electronic transfer] that is equal two the gross donations or contributions made through FundLibraries.org net of refunds and minus ELI's 10 percent (10%) Payment Processing Fee. All payouts, proceeds, and settlements will be issued in US funds. 

Campaign Managers must provide a valid mailing address in order to be paid out. ELI cannot guarantee delivery of your payment without a valid address. Please review your profile to update your address and email [email protected] with questions.

Check not cashed or claimed within six months of issue date will be voided and not honored.
